Terms of Service

These Terms of Service ("Terms") govern your access to and use of Verisdiction, an age-verification compliance service operated by Divine Entertainment LLC ("Verisdiction," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organization you represent ("you" or "Customer").

1. The Service

Verisdiction provides a configurable, drop-in age-verification "gate" and a related set of tools, APIs, and a per-jurisdiction ruleset that returns recommended age-verification settings based on a visitor's detected location. You install the Service on your website(s) and configure how and where age checks appear. You connect your own third-party identity- or age-verification provider; Verisdiction routes verification to that provider and records only the pass/fail result.

2. Not legal advice; your responsibility for compliance

Verisdiction is a software tool, not a law firm, and nothing we provide is legal advice. The jurisdiction data and recommended settings we surface are informational, are prepared with input from counsel, and may be incomplete, out of date, or inaccurate. You are solely responsible for determining your legal obligations, for configuring the Service appropriately, and for your own compliance with all applicable laws. You control every setting and may override any recommendation. We do not guarantee that any configuration will satisfy any particular law or prevent any enforcement action, fine, or liability.

3. Eligibility and accounts

  • The Service is for business use. You must be at least 18 and authorized to bind your organization.
  • You are responsible for the security of your account credentials and for all activity under your account.
  • You must provide accurate information and keep it current.

4. Acceptable use

You agree not to: (a) use the Service to violate any law or third-party right; (b) misrepresent the Service's verification results; (c) reverse engineer, resell, or provide the Service to third parties except as expressly permitted; (d) interfere with or disrupt the Service; or (e) use the Service to gate, distribute, or facilitate unlawful content.

5. Verification and end-user data

You bring your own verification provider and maintain your own relationship and agreement with that provider. As between you and Verisdiction, you are the controller of your end users' personal data. Verisdiction processes only limited data necessary to route a verification and to record a pass/fail outcome and assurance level — we do not store government IDs or biometric source images. Our handling of data is described in our Privacy Policy.

6. Fees, plans, and billing

  • Plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor (Stripe). Annual plans may be offered at a discount.
  • Domains and add-ons. Each plan includes a number of domains; additional domains and optional add-ons (such as managed enforcement) are billed per domain at the rates shown at checkout and on our pricing page. Changing your domains or add-ons adjusts your charges, prorated where applicable.
  • Taxes. Fees are exclusive of taxes, which you are responsible for.
  • Renewal. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Refunds. Except where required by law, fees are non-refundable.

7. Third-party services

The Service relies on and integrates with third parties (for example, your verification provider, Stripe for payments, and content-delivery/edge providers). Your use of those services is subject to their terms, and we are not responsible for them.

8. Intellectual property

We and our licensors own all rights in the Service, including the software, ruleset, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your content and configurations.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ITS DATA WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR LEGALLY SUFFICIENT FOR ANY PURPOSE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERISDICTION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY FINES, PENALTIES, OR LOST PROFITS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You will defend, indemnify, and hold harmless Verisdiction from and against any claims, damages, and costs arising from your use of the Service, your content, your configurations, or your violation of these Terms or applicable law.

12. Term and termination

These Terms apply while you use the Service. We may suspend or terminate access for breach, non-payment, or to comply with law. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Changes

We may update the Service and these Terms. Material changes will be posted here with a new "Last updated" date; continued use after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-laws rules. The state and federal courts located in Nevada will have exclusive jurisdiction, except where applicable law provides otherwise.
